Current US tariff rates on Chinese-origin goods — MFN base rate, Section 301 surcharges (Lists 1–4), and the Section 122 surcharge (10%, replaced IEEPA after the Feb 2026 Supreme Court ruling) — combined into a single effective rate by HTS code.
The standard Most Favored Nation duty rate that applies to all WTO member countries. Ranges from 0% (Free) to 37.5% depending on the product category.
Additional duties imposed by USTR on Chinese goods. List 1–3: 25% additional. List 4A: 7.5% additional. Applies to the vast majority of goods imported from China.
The Supreme Court struck down IEEPA tariffs on Feb 20, 2026 (Learning Resources v. Trump, 6–3). A 10% Section 122 global tariff replaced them on Feb 24, 2026. It expires ~July 24, 2026 unless Congress acts.
Combined effective rate example: A product with 5% MFN + 25% Section 301 (List 1) + 10% Section 122 = 40% total duty rate before MPF and HMF.

Section 122 global tariff (10%) takes effect
Temporary 10% tariff under Section 122 replaces IEEPA on most imports. Expires ~July 24, 2026 unless Congress acts.
As of May 2026, most Chinese goods face: MFN base rate + Section 301 (7.5–25%) + Section 122 surcharge (10%, effective Feb 24, 2026). Combined effective rates typically range from 17.5%–40%+ depending on the product.
Section 301 tariffs are additional duties on Chinese goods imposed by USTR under the Trade Act of 1974. Lists 1–3 carry 25% additional duty; List 4A carries 7.5%. These stack on top of the MFN base rate.
The Supreme Court struck down all IEEPA tariffs on February 20, 2026 in Learning Resources v. Trump (6–3 ruling). The Court held IEEPA does not authorize tariff-setting. Congress enacted a temporary 10% Section 122 surcharge as a replacement, which took effect February 24, 2026 and expires ~July 24, 2026.
Total rate = MFN base rate + Section 301 (check which list covers your HTS code) + Section 122 (currently 10%). For example: 5% MFN + 25% Section 301 (List 1) + 10% Section 122 = 40%. Add MPF (0.3464%, min $33.58, max $651.50) and HMF (0.125%) for the full CBP fee burden.
